TERMS AND CONDITIONS IN

MOABI HOTEL

 

 

1. The hotel registration serves as proof of the lodging contract between the hotel and the guest. The contract is accepted through the guest's signature. This contract is one of adhesion, which means the guest agrees to the stipulations contained herein.

2. The guest acknowledges and accepts the terms regarding the type of room, the rate charged for the lodging service, as well as the check-in and check-out dates recorded in their registration

3. Payments:

- Payment for the rooms must be made according to the conditions of the reservation prior to the guest's arrival at the hotel or at check-in, either in cash or by credit card.

- The guest must also pay for all charges related to food, beverages, laundry, and any other services incurred during their stay and charged to their account.

- The guest acknowledges being informed of the rates, fees, and general nightly room prices.

- Failure to comply with the agreed payment terms will result in late payment interest charges at the maximum rate allowed, in accordance with Article 884 of the Commercial Code.

- The guest authorizes the invoice to be sent to the email address provided.

4. Check-in is from 3:00 PM, and check-out is until 12:00 PM. Early check-ins and late check-outs are subject to availability and may incur additional charges in some cases.

5. Moabi Hotel provides a safety deposit box in your room. The guest acknowledges and accepts the hotel's exclusion of liability for the loss or theft of belongings not handed over to the hotel for safekeeping or properly secured. According to Article 1195 of the Commercial Code, guests may deposit money and valuable items with the hotel for safekeeping under a receipt. This must be done through the hotel’s designated official, and an inventory document must be prepared listing the money or items handed over. The hotel’s responsibility will be that of a custodian, in accordance with Article 1196 of the Commercial Code. Valuable items such as jewelry, cameras, money, computers, cell phones, equipment, or utensils left in the room or in service areas other than those designated by the hotel for safekeeping will remain at the guest's sole risk, as the hotel does not assume any liability in the event of loss or damage in such cases.

6. We kindly request that guests respect the hotel's quiet hours. Parties, music, and any noise that disturbs the peace are strictly prohibited after 11:00 PM. Failure to adhere to this rule may result in a fine of up to $100 USD per violation. Additionally, it could lead to police intervention, power disconnection, or, in cases of repeated misconduct, a request to leave the hotel.

7. Smoking is prohibited in the rooms and common areas; these spaces must remain tobacco-free. The use of electronic cigarettes is also not allowed in these areas. We appreciate your understanding.

8. Hotel Moabi does not permit the use of its facilities for the sexual or commercial exploitation of children and adolescents, in accordance with Laws 1336, 1236, and 1329. Therefore, guests must adhere to these legal regulations during their stay. Sexual and drug trafficking is illegal in Colombia, and any evidence of drug abuse, prostitution, child abuse, or any other behavior unrelated to tourism or business travel may be reported to authorities by hotel security or other guests.

9. Visitors: Each room type has a maximum capacity that must be respected at all times (2 or 3 people, depending on the room type). At check-in, all guests must be registered according to the reservation details (number of guests). A maximum of one unregistered visitor is allowed, provided the reservation complies with these conditions. However, this does not exempt the visitor from being registered upon entry. If the initial reservation is for one person, additional charges will apply for the admission of a second person.

10. All adults must be registered at reception with a physical Citizenship ID or Passport, and minors must present a notarized written authorization from their parents or legal guardians before entering the hotel. By authorizing the entry of visitors, the guest assumes responsibility for their behavior, which must comply with the terms and conditions of this contract.

11. Any attempt to bring a minor into the hotel without their legal guardian or to present false documentation will be immediately reported to the authorities.

12. If you decide to extend your stay, please notify us at least 24 hours in advance so that we can, subject to availability, keep the same room for you.

13. If, for any reason, you need to end your trip earlier than planned, please note that we cannot provide a refund. Moabi Hotel does not offer refunds or adjust accounts for early departures.

14. Our rooms are exclusively intended for tourism or business lodging. Moabi Hotel is not a medical facility; therefore, the establishment does not provide specialized cleaning, disinfection, or handling of biological waste. As such, we are not responsible for post- operative health complications, which must be treated in medical centers.

15. The guest may not transfer the room to another person without prior authorization from Moabi Hotel.

16. The hotel offers online check-in and digital key generation to streamline and enhance your stay. However, until the room payment is completed, our web app will not allow you to generate a digital key. Our reception staff will assist you with this process upon arrival if needed. Alternatively, if you prefer a card or tag for room access, you can request it at the reception desk.

17. In case you lose your key (tag), a fee of 80,000 COP will be charged.

18. The guest must use the furniture, appliances, equipment, and facilities of both the room and the hotel appropriately, maintaining them in their original condition. Therefore, the guest will be held responsible for any damage or loss to the property of Moabi Hotel, including minor negligence. In the event of total or partial loss or damage to hotel property caused by the guest or their companions, the guest will be required to pay the cost of repair or replacement, as applicable.

19. Privacy Notice: I expressly and unequivocally authorize Instantes Group SAS to process my personal data in accordance with Law 1581 of 2012 and its regulatory decrees.

20. A 19% VAT will be charged to residents of Colombia, including Colombian nationals and foreigners with a foreign ID card. Non-resident foreigners with a tourism, business, or student visa are exempt from this tax.

21. Fines: Smoking in the room or any other area of the hotel constitutes a serious breach of the lodging contract, which may result in its termination. The guest may be removed from the hotel if their actions have negatively affected other guests, visitors, or users. If the guest smokes in the room, they will be required to pay: (i) the cost incurred by the hotel to deodorize and clean the room, estimated at an amount equivalent to USD.

22. calculated at the representative market exchange rate on the payment date, and (ii) the value of two (2) nights at the applicable rate for their accommodation, as the cleaning and deodorizing process renders the room unavailable for the following two (2) nights. If the guest smokes in any other area of the hotel outside the room, they must pay the cost of deodorizing and cleaning that area, which is equivalent to USD.

24. The lodging contract will be terminated under the following circumstances: - Upon expiration of the agreed-upon term. - For failure to fulfill any obligations by either party, particularly for non-payment of the room rate or charges for food, beverages, or other complementary services that the guest has added to their room or personal account.

- In cases where, at the hotel's sole discretion, the guest's behavior or attire disrupts the peace and/or health of other guests or hotel visitors. - For smoking in the room or any other smoke-free area of the hotel, especially when it affects other guests, visitors, or users, without prejudice to the payment obligations outlined below.

- Termination of the contract does not exempt or release the guest from paying any outstanding balances.

24. Effects of Termination:

- Upon termination of the contract, the hotel may freely dispose of the room.

- Upon termination of the contract, regardless of the reason, the hotel is authorized to enter the room, prepare and sign an inventory of the guest's belongings and luggage, and remove them from the room to store them in a secure and suitable location. This will be done at the guest's expense and risk, with no liability on the part of the hotel.

- If the guest fails to pay the bill or any portion thereof, the hotel may dispose of and sell the guest's and their companions' luggage and belongings in accordance with Article 1199 of the Commercial Code. The proceeds will be used to cover the outstanding obligations. Any surplus, if applicable, will be made available to the guest. In the event of a deficit, the hotel may initiate appropriate actions to recover the total amount owed.

25. The guest agrees that the liquidated amount of money stated on the invoice shall constitute an enforceable claim.

26. Moabi Hotel reserves the right not to extend this lodging contract upon its conclusion.
